The developers of Degen Den ("Degen Den," "we," "us," or "our") provide live stream betting, arcade games, and related interfaces (collectively, the "Degen Den Service") via the Degen Den website and associated smart-contract front-ends. By connecting a wallet, placing a bet, starting a game session, or otherwise using the Degen Den Service, you ("User" or "you") confirm that you've read, understood, and agreed to these Terms of Service (the "Terms"). The Privacy Policy and any additional rules or guidelines displayed on the Degen Den Service form part of these Terms.

PLEASE READ CAREFULLY. THESE TERMS CONTAIN (1) A BINDING ARBITRATION AGREEMENT AND (2) A CLASS-ACTION WAIVER. THEY AFFECT YOUR LEGAL RIGHTS.

We may update these Terms at any time. If we do, we'll post the new version here and update the "Effective Date." Except for changes addressing new features, amendments take effect fourteen (14) days after posting. Continued use constitutes acceptance.

1) What is the Degen Den Service?

a. Overview

Degen Den is a live stream betting and arcade gaming platform deployed on Solana. You can bet on live-streamed games in real time (e.g., Target Splash) or play arcade-style games (e.g., Electric Mines, Shock Chamber) against the house. Each session is recorded on chain. Game outcomes and prize payouts are governed by the applicable smart contracts.

b. Not a Security

Game sessions, bets, points, and any associated digital assets are entertainment products, not securities, commodities, or financial instruments.

c. Prohibited Countries

The Degen Den Service is not available globally. You may only use it if you are not a resident of or located in a Prohibited Country.

Prohibited Countries (subject to change):

Afghanistan, Australia, Austria, Belarus, Canada, China (Mainland), Cuba, France, Germany, Hong Kong (China), Indonesia, Iran, Myanmar, Netherlands, North Korea, Russia, Singapore, Spain, Sudan, Syria, Ukraine, United Kingdom, United States, Venezuela.

You represent and warrant that you are not accessing from a Prohibited Country and agree not to use IP-masking or VPNs to bypass restrictions. We reserve the right to terminate access and invalidate rewards if you misrepresent your location.

2) Using Degen Den

a. Connect a Digital Wallet

You must connect a compatible Solana Chain wallet. You control your private keys; we never have custody.

b. Eligibility

You must be 18 years or older and legally permitted to participate in games of chance where you reside.

c. Accuracy of Information

If you provide information (e.g., username or email), you agree it's true, current, and complete.

d. Security

You're responsible for safeguarding your wallet credentials. Lost keys are irrecoverable.

e. Changes to the Service

We may modify, suspend, or discontinue features at any time without liability.

3) Rules of Conduct

While using the Service, you agree not to:

• Access the Service from, or on behalf of, a Prohibited Country.
• Use bots, scripts, or automation to gain an unfair advantage.
• Upload or distribute viruses, malware, or unlawful content.
• Reverse-engineer or exploit the Service or its smart contracts.
• Violate any applicable law, including AML and sanctions regulations.
• Copy or adapt the Service to build a competing product.

4) Intellectual Property

All software, text, graphics, logos, and other content in the Degen Den Service ("Degen Den Content") are owned by or licensed to us.

Except as expressly permitted, you may not copy, modify, distribute, create derivative works from, or reverse-engineer any Degen Den Content.

"Degen Den" and related marks are trademarks of the contributors.

5) Payments, Fees & Taxes

• Entry Fee – Current entry fees and prize amounts are shown before you start a session and may change at any time.
• Network (Gas) Fees – You're responsible for all blockchain transaction fees.
• Taxes – You bear sole responsibility for reporting and paying any taxes arising from your use of the Service.

6) Legal Terms

a. Indemnification

You agree to indemnify and hold harmless the Degen Den contributors and their agents from any claim, liability, loss, or expense arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

b. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

c. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY SHALL NOT EXCEED USD 100 OR THE TOTAL AMOUNT YOU PAID IN THE SIX (6) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

d. Beta Features

Any feature labeled "Beta" is experimental. You assume all associated risks.

7) Termination

We may suspend or terminate your access to the Degen Den Service at any time, with or without notice. Sections intended to survive termination (e.g., indemnity, limitation of liability, arbitration) will continue in effect.

8) User Disputes

We do not mediate disputes between Users. You release us from any claims arising out of interactions with others.

9) Privacy

Please review our Privacy Policy for details on how we collect, use, and share data. By using the Service, you consent to those practices.

10) Dispute Resolution by Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY—IT AFFECTS YOUR LEGAL RIGHTS.

Agreement to Arbitrate

Any dispute arising out of or relating to these Terms or the Degen Den Service shall be resolved exclusively by final and binding arbitration. You waive the right to trial by jury and to participate in class actions.

Class-Action Waiver

Claims may only be brought in your individual capacity. The arbitrator may not consolidate claims or preside over any class- or representative-action proceeding.

Pre-Arbitration Notice

Before initiating arbitration, you must email a written Notice of Dispute to contact us via our Discord ticket support describing your claim. If the dispute is not resolved within sixty (60) days, either party may commence arbitration.

Costs of Arbitration

You're responsible for all filing, administration, and arbitrator fees and expenses. Degen Den will not subsidize any portion.

Confidentiality

All arbitration proceedings, filings, and awards are confidential except as required to enforce an award or by applicable law.

Future Changes

If we change this Arbitration Agreement, you may reject changes by contacting our Discord ticket support within thirty (30) days of the change; otherwise, the change is binding.
